1. Agreement to these terms

These terms are a legal agreement between you and Hermes Logistics Corp governing your use of this website. By using the site you accept them. If you do not accept them, please do not use the site.

2. What this website is

This site describes what Hermes Logistics Corp does and gives you a way to contact us. It is informational. Nothing on it is an offer capable of acceptance, a quotation, a booking, a rate confirmation, or a commitment to carry, store, inspect or handle any cargo.

3. Services are governed by a separate agreement

These terms do not govern freight forwarding, transport, warehousing, supplier inspection or any other service we may perform for you. Those are governed exclusively by the separate written agreement, rate quotation, booking confirmation and terms and conditions of service agreed between us for that engagement. Where anything on this site conflicts with that agreement, the agreement prevails.

4. Enquiries and quotations

Submitting the enquiry form does not create a contract and does not oblige us to provide any service. Any quotation we give in response is an estimate, is valid only for the period and on the conditions stated in it, and is subject to carrier space and equipment availability, cargo details being as described, and our acceptance of the booking.

You are responsible for the accuracy and completeness of the information you give us about your cargo, its origin, its value and its classification.

5. Acceptable use

You agree not to:

• use the site for any unlawful purpose, or in breach of applicable export control, sanctions or customs law;
• submit false, misleading or impersonating information through the enquiry form, or use it to send unsolicited commercial messages;
• attempt to gain unauthorised access to the site, its servers or any connected system, or probe, scan or test its security;
• interfere with the site’s operation, including by overloading it or introducing malicious code;
• scrape, harvest or systematically extract content from the site, or use it to train a machine learning model, without our written permission.

6. Intellectual property

The site and everything in it — text, layout, design, graphics, photography, the HERMES name and mark, and the software that runs it — belongs to Hermes Logistics Corp or its licensors and is protected by copyright, trade mark and other laws. You may view and print pages for your own business use in evaluating our services. You may not otherwise copy, republish, distribute, modify or create derivative works from the site without our written permission.

7. Accuracy of content

We take care over what we publish here, but service descriptions, capabilities and coverage are general and may change. Nothing on this site is professional, legal, customs or regulatory advice, and it should not be relied on as the basis for a commercial decision without speaking to us directly.

8. Third-party links

Where this site links to a third-party site, we do so for convenience. We do not control those sites, we do not endorse them, and we are not responsible for their content, their availability or their handling of your data.

9. Disclaimer of warranties

To the fullest extent permitted by law, this website is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, Hermes Logistics Corp will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data, business or goodwill, arising out of your use of or inability to use this website — whether the claim is brought in contract, tort or otherwise, and even if we were advised such damages were possible.

Our total liability arising out of or relating to this website will not exceed one hundred US dollars (USD 100). This clause limits liability for the website only; liability arising from services we perform is addressed in the separate agreement covering those services. Nothing here excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify and hold harmless Hermes Logistics Corp and its officers, employees and agents from any claim, loss or expense, including reasonable legal fees, arising out of your breach of these terms or your misuse of the site.

12. Privacy

Our handling of personal information is described in our Privacy Policy and our Cookie Policy, which form part of these terms.

13. Changes

We may revise these terms at any time by posting an updated version on this page. The effective date at the top shows when they were last revised. Continuing to use the site after a change means you accept the revised terms.

14. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. You and we submit to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida for any dispute arising out of them.

15. General

If any provision of these terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies referenced in them, are the entire agreement between us regarding this website.
